Chief Judge John McConnell also issued a harshly critical letter to an assistant U.S. Attorney, but stopped short of formal disciplinary proceedings.
In May, the court appointed a special counsel to investigate the possibility of misconduct by Assistant U.S. Attorney Kevin Bolan. Bolan admitted that he had not the judge all the necessary information before she released a man from ICE custody.
The man was wanted for homicide in the Dominican Republic, but prosecutors never disclosed that to Judge Melissa DuBose.
After the release of Bryan Rafael Gomez, the Department of Homeland Security issued a press release and social media posts condemning her as an activist judge. The press release remains active on the DHS website.
The counsel’s report noted that the government’s response to Gomez’s request for release “deliberately did not disclose that Mr. Gomez faced awarrant related to alleged homicide.”
It also noted that the DHS press release singled out “Judge DuBose by name, criticizing her ruling and falsely suggesting that she knowingly ‘released a violent criminal illegal alien who is wanted for murder in the Dominican Republic.’”
So ICE withheld history of a violent person and when the judge ordered them released, the violent person became violent. Now ICE is trying to say “see! this activist judge is releasing bad brown people” as a way to remove her from the bench.
Markwayne Mullen should answer these questions while in front of Congress. Get some of this out in the video news cycle.
They may not even care about removing her from the bench. Just the accusation allows them to stir up their base and increase their voter counts.
That’s good, because we’ve all seen with our own eyes and ears how effective strongly worded letters are against the terrorist regime in the White House.
