Quite the opposite. The state constitution says replacements are appointed. Recent legislation that has not (yet) been tested in court calls for a special election.

They have to pretend he’s alive until the 3rd. A Kentucky law passed in 2024 requires a special election to be held to fill vacant Senate seat. But that law doesn’t apply if the vacancy occurs within 90 days of the seat being up for election.
Mitch’s seat being empty is better for the fascists than the risk of a Democrat taking the seat in the leadup to an election the GOP plans on fucking with.
