This week, two years after the alleged assault, Sulkowicz, a visual-arts major, has made a promise to carry her mattress around campus every day as part of her senior thesis. It is, she says, a symbol of the burden sexual-assault survivors carry with them every day.
“The act of carrying the mattress from inside my room out into the light has mirrored the way my life has changed, as I’ve brought my personal story out into the light,” Sulkowicz told TIME. “This project is a way to heal one of the most difficult things that happened to me. As I will build muscle and get stronger, hopefully I will also build emotional strength.”
Sulkowicz started the performance-art project on Tuesday, and she said she is determined to continue carrying the mattress wherever she goes — to class, the library, the gym — as long as her alleged rapist is still on campus. That means her project could last until graduation day in May 2015 — unless her alleged assailant is either expelled or chooses to leave the school. This reminds me of a reddit post from a while ago. Dude is going to a university in the US. He’s randomly contacted by campus police to let him know that a student has taken out a restraining order on him. He’s a graduate student, and the student who took out the restraining order is from one of his classes that’s typically for undergrads. Other than sharing that class, he doesn’t know the student. Never even spoken to them. He’s on a student visa, if he’s expelled, he’ll likely be deported. He’s not allowed to speak to the student and campus police won’t even tell him why the restraining order is in place.
After doing some investigation on his own, he finds out the student is dating one of his roommates, who he also doesn’t know very well. The roommate is stalking the student, and another roommate is helping the stalker.
The student who took out the restraining order had seen him with the stalker at some point and, because the class they share is typically for undergrads, assumed he only took the class to keep an eye on the student for the stalker.
He was able to go to his graduate advisor about it and luckily it all got cleared up, the student withdrew the restraining order. But his whole academic career was nearly derailed because a random person was able to take out a restraining order on him with zero direct evidence, and there was no established means by which he could defend himself.
That’s why you shouldn’t let university staff do police work or become Dredd (judge, jury & executioner). Professionals have trained for years to get this stuff right but “campus police” thinks they can do it without any proper training or investigation.
“Campus Police” are regular police (for all that’s worth), not rent-a-cops. Their jurisdiction is University and University-related policing. Think of the University as being its own city.
I teach nights at a university and UPD is pretty great. The city cops are very much out to get people, whereas the UPD has a very light touch. They’ll bust a party with a bunch of 19yo Kids drinking too much and getting loud, and tell them to keep it down and stay safe, while offering to call a non-police volunteer to drive anyone home for free.
Parking Services (not part of UPD) can get go suck on a tailpipe though. Fuck those guys.

They are given due process, including access to lawyers, evidence, and witnesses. They’re even allowed to take the case to court. All public universities are required to offer full due process when expelling students.
Private universities are not required to do so because they’re not run by the government.

Due process protects you from the government. You don’t get due process when you get kicked out of a private business or university for misbehaving. They can kick you out for no reason at all.

That is a major issue. Kicking someone out of university is a life-changing punishment, and should not be taken so lightly when someone may be innocent. There should be rules about that and I don’t think this should be normalized.
Getting fired is life changing yet we accept that we could be fired at any time for no reason here in the US. Protections against getting arbitrarily kicked out of a private university would require legislation. Right now that’s a risk you assume when you go to a private institution versus a public one.

People should not be subject to arbitrary harm from others and we should be against all forms of it, whether that’s sexual assault, economic coercion or lack of due process.

My point is solely and entirely about the basic human right of due process: anyone should be considered innocent until proven guilty, no matter the gender or crime. That doesn’t mean don’t believe the accuser, but it means really take the charges seriously, investigate the crime to the best of your system’s abilities and if after all that there is insufficient evidence, there should be no conviction. Not by the justice system or the university. If he is guilty, as with any other crime, the system has failed. But until there is some major breakthrough, this is the best system we have.
As a more general point: the US is already falling into a society of lawlessness. Now you don’t have to go all Michelle Obama “When they go low, we go high” but at least don’t play their hand by inciting more lawlessness. I really don’t think you will win that war…

I just really have to disagree here. Growing up in the 90s, blatant misogyny was utterly pervasive throughout our culture. Now raising a son, sometimes 90s (or earlier) media comes on and the sexist tropes make me cringe.

I’m not judging, just thought it was useful information to add.
Turns out nothing much has changed when it comes to treating rape like the serious crime that it is.
I don’t think that is entirely true. The metoo movement has caused a lot of public awareness and outcry, which is still effective today. Even now, more women speak about their experience, which keeps the conversation going and keeps opening people’s eyes. Because it is easier (in a public sense) to talk about rape, ther is less judgement and more support.
There is now a culture around consent and how important that is. There is now also attention for power inbalace, like a boss and a employee. This even lead to a massive jiurnalist investigation in 2022 in my country (netherlands), where a few key figures in “The Voice Holland” were exposed as rapists. Two were taken to court, one got convicted.
I’m a simple white man, but from what I hear and see, there are a few things better than it was in 2014.
My country has also adopted a law in 2024 that broadens the spectrum of what can be classified as rape. Now you don’t have to prove force or violence, but things like coercion or online behaviour also counts as evidence. It is also easier to press charges.
There is still plenty of problems surrounding the treatment of rape a a serious crime, but I think it is better than in 2014. What is still definitely a problem, is that that the law requires hard evidence and rape is hard to prove with hard evidence. In that case it will always be your word against their’s. That has still not been solved, and is the reason why many rape cases don’t make it to court (because they don’t have the evidence and there no chance). But this is actually a hard problem to solve.
This post was probably in response to the recent Cornell 7 situation.
A former Cornell student was drugged and gang-raped in a frat house for 7 hours in 2024. When she reported it, two of the rapists were expelled, and five more had to write an essay about why rape is bad. No criminal charges were brought against any of them, even the two who were expelled. Zero arrests. The entire frat house knew about it, and even the ones who refused to participate in the gang-rape chose to do nothing.
The case recently went viral because she is suing the seven men and the college. And now that it has gone viral, investigators have said they’re going to reopen the criminal investigation that they previously closed. But they’re only doing that because it quickly became apparent that the police intentionally refused to do anything about it, and now they have egg on their face.
And this isn’t just a he-said-she-said situation where there is some ambiguity about whether or not the attack happened. We have text messages from the frat members, telling each other about the free pussy in the bedroom, and to just walk in and whip it out. She had been repeatedly drugged with ketamine and liquor throughout the 7 hour long gang rape, and all 7 knew she was completely out of it and unable to consent. Those are direct quotes, by the way. This photo was entered as evidence in New York’s court:

I’m in the US and we have such long backlogs of rape kits that are never even tested:

Just got done reading the Wikipedia article on the matter. NYPD and the DA declined to pursue charges and the guy ended up suing Colombia for how they handled the proceedings on title IX gender discrimination violations. That lawsuit was settled.
WaPo is cited in there, it was bought by Bezos in '13.
The details of the settlement are sealed and it doesn’t prove that the rape didn’t happen, only that charges were never pressed against him for rape.
Considering the lengths that these Universities routinely go through to bury these stories, hide evidence, and not give evidence over to the DA and police departments, I have significant doubts that Columbia did the right thing here.
It is also impossible to prove rape didn’t happen. There’s no way you could conclusively prove right now that you haven’t raped me.
Which is why we have this whole innocent until proven guilty thing, which absolutely sucks if you’re a victim, but guilty until proven innocent is an even worse system.
Until either conclusive proof about the rape is presented or she admits to lying, as far as I’m concerned, he didn’t rape her and she isn’t lying about it.
I’m also not entirely sure it should be up to a university to investigate these things. That’s something the police should be doing and you Americans need to start lighting fires under their asses until they finally start taking rape cases seriously.
Given how quickly Columbia capitulated to Trump as well as its abysmal treatment of protestors it is almost certain the administration didn’t do the right thing.

No charges were ever filed against Paul Nungesser. Columbia University found him not responsible in their inquiry, NYPD declined to charge him, and the district attorney said there was no reasonable suspicion.
Nungesser did end up suing the school for a Title IX violation and they settled out of court.
